Article 1 – Formation of the Agreement

• The rental agreement is concluded once the tenant accepts the offer of Private Apartment Sirena Resort 7b and receives written confirmation by email.

Article 2 – Rates & Payment

• All amounts are stated in USD.
• For the Non-Refundable rate, 100% of the rental amount must be paid at the time of booking.
• For the Standard rate, the tenant must pay a 50% deposit within 10 days after reservation. This deposit is non-refundable once the booking has been confirmed.
• Tourist tax (7% sales tax), fixed costs for water and electricity, cleaning fees, and the Resort Service Fee are included in the total rental amount, unless stated otherwise. These costs will be itemized during the online booking process.

Article 3 – Modification or Cancellation by Tenant

• Changes to an existing booking are subject to availability and incur an administrative fee of USD 45. Cancellation conditions depend on the selected rate.
• In case of cancellation of a Non-Refundable booking, no refund will be provided / returned.
• In case of cancellation of a Standard rate booking, the following applies: if canceled more than 30 days prior to the arrival date, the tenant shall be liable for an additional cancellation fee of 10% of the total rental amount, in addition to the deposit already paid. If canceled within 30 days prior to the arrival date, the tenant shall be liable for 100% of the total rental amount.

Article 4 – Stay & Use of the Apartment

• It is not permitted to occupy the apartment with more than 4 persons, unless agreed upon in writing.
• The tenant and any co-occupants are, pursuant to the deed of division, required to comply with the provisions of the regulations, the house rules, and any additional rules as referred to in Section 5:128BW, insofar as these apply to them as users.
• The accommodation must be used responsibly, kept clean, and left in good condition upon departure.
• Late check-out, additional cleaning, or children’s amenities (such as a crib or high chair) are available upon request and subject to additional charges.
• Pets are strictly prohibited.
• Smoking inside the apartment is strictly prohibited.
• The use of drugs or abuse of alcohol is strictly prohibited.
• Visitors are allowed but must be registered at reception when using resort facilities. A day-pass policy applies.

Article 5 – Damage & Liability

• A Resort Service Fee is charged per night for each booking. This contribution funds a damage waiver covering minor accidental damages during your stay. For intentional or major damage, you remain fully liable. Report any damage immediately to reception or no later than check-out. Intentional damage, theft, or gross negligence may result in denial of access and recovery of all associated costs.

Article 6 – Facilities & House Rules

• All guests have access to the resort facilities, including swimming pools, jacuzzis, BBQ area, volleyball area, mini golf, gym, and playground.
• Use of these facilities is subject to the house rules and as described in the Frequently Asked Questions (FAQ).
• Guests are not permitted to engage in behavior that poses a risk to themselves, other guests, staff, or property (hazardous conduct). In case of serious violation of house rules, nuisance, disturbance, or hazardous conduct, the stay may be terminated immediately without refund or compensation.

Article 7 – Insurance

• We strongly recommend that every tenant obtains travel and cancellation insurance with worldwide coverage, including coverage for damage to the accommodation or its contents.

Article 8 – Force Majeure & Changes by Lessor

• In the event of force majeure (such as natural disasters, storm damage, government measures, or technical failures), we (Private Apartment Sirena Resort 7b) may be required to cancel or modify a booking. In such cases, an comparable alternative will be offered in consultation with you, or a (partial) refund will be provided. We are not liable for consequential damages or loss of vacation time beyond our control.

Article 9 – Processing of Personal Data

• Personal data is processed solely for reservations, communication, administration, and guest management, in accordance with applicable privacy laws (GDPR). Data will not be shared with third parties unless required by law or necessary for the execution of the stay.

Article 10 – Governing Law

• These terms and conditions are governed by the laws of Curaçao. In the event of disputes, parties will seek to resolve the matter amicably.

Disclaimer

Private apartment Sirena Resort 7b is an independently owned apartment located within Sirena Resort Curaçao. While the resort provides on-site management and facilities, the rental agreement applies specifically to the private apartment. Sirena Resort Curaçao is responsible for the daily management, maintenance, and guest experience. Private Apartment Sirena Resort 7b reserves the right to amend these terms and conditions at any time. The most current version is always available on our website.
